Welcome to HappyHorse AI ("we," "us," or "our"), an AI video generation platform available at happyhorseai.top (the "Service"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Service.

2. Description of Service

HappyHorse AI is an online platform that allows users to generate AI-powered videos from text prompts or images using the HappyHorse AI model by ByteDance. Features include:

Text-to-video generation
Image-to-video generation
Built-in AI audio generation
Multiple resolution and duration options

Disclaimer: HappyHorse AI is an independent platform. We are not affiliated with, endorsed by, or officially connected to ByteDance. We provide access to AI video generation technology through authorized API services.

3. Payment Processing

All payments for our Service are processed by Creem (creem.io), which acts as the merchant of record for all transactions. This means:

Creem processes your payment, handles billing, and manages tax compliance on our behalf.
Your payment receipt and invoice will come from Creem.
By completing a purchase, you agree to Creem's Buyer Terms in addition to these Terms.
Creem is responsible for collecting applicable taxes (VAT, sales tax, etc.) based on your location.

4. Subscription Plans and Credits

Plans

We offer subscription plans (Basic, Standard, Pro) with different credit allocations, feature access, and pricing. Plan details and current pricing are available on our Pricing page.

Credits

Credits are used to generate videos. The cost per generation depends on resolution, duration, and generation mode.
Credits are allocated monthly upon subscription payment and expire at the end of each billing cycle.
Unused credits do not roll over to the next billing period.
Credits have no cash value and are non-transferable.

Free Credits

New registered users may receive bonus credits upon account creation.
Free credit availability and amount are subject to change.

5. Subscription Management and Cancellation

You may cancel your subscription at any time through your Billing settings.
Cancellation takes effect at the end of the current billing period — you retain access to your plan features until then.
No partial refunds are issued for the remaining days of a billing period after cancellation.
After cancellation, your account reverts to a free account with no credits.

7. Acceptable Use

You agree not to:

Generate sexually explicit, pornographic, or NSFW content of any kind
Generate content that is illegal, harmful, harassing, defamatory, or violates others' rights
Generate content depicting child exploitation or non-consensual intimate imagery
Generate deepfake content intended to deceive, defame, or impersonate real individuals
Use the Service to infringe on intellectual property rights
Attempt to reverse-engineer, decompile, or extract the underlying AI models
Use automated tools to abuse the Service or circumvent usage limits
Attempt to bypass content safety filters or moderation systems
Resell or redistribute generated content in violation of your plan's license terms
Share account credentials or allow unauthorized access to your account

8. Content and Intellectual Property

Your Content

You retain ownership of the text prompts and images you provide.
For videos generated using the Service, your usage rights depend on your plan:
- Basic and Standard plans: Personal and social media use.
- Pro plan: Full commercial license for ads, client work, and products for sale.

Our Content

The Service, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws.
"HappyHorse AI" and associated branding are our trademarks.

AI-Generated Content

AI-generated content may not be eligible for copyright protection in all jurisdictions.
We do not guarantee that generated content will be unique or free from similarity to existing works.

9. Limitation of Liability

To the fullest extent permitted by law:

The Service is provided "as is" and "as available" without warranties of any kind.
We are not liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not responsible for the quality, accuracy, or appropriateness of AI-generated content.

10. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service.
We may perform maintenance, updates, or changes that temporarily affect availability.
We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

11. Account Termination

We may suspend or terminate your account if:

You violate these Terms or our Acceptable Use policy
Your account is used for fraudulent activity
Required by law or legal process
